WIZDOX TERMS OF SERVICE

1. AGREEMENT TO TERMS

By accessing or using the WizDox Platform at wizdox.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms apply to all users, including individual consumers ("B2C") and businesses or professional users ("B2B"). Where a distinction applies, it will be noted explicitly.

These Terms constitute a legally binding agreement between you and Daniel Barna, sole trader established in Portugal, trading as WizDox, NIF 305655981, R. Pedro Nunes 6, Oeiras, Portugal.

2. DESCRIPTION OF SERVICE

WizDox is a document preparation service. We help you generate pre-filled application forms for U.S. vital records — including birth certificates, death certificates, marriage certificates, and divorce records — and for apostille requests. We also provide mailing instructions tailored to the specific U.S. state and record type you are requesting.

WHAT WIZDOX DOES NOT DO

WizDox explicitly does not:

  • Submit any application, form, or document to any U.S. government authority on your behalf
  • Guarantee that any government office will process, accept, approve, or issue any record
  • Guarantee that a certified record will arrive within any particular timeframe
  • Provide legal advice, legal representation, or attorney services of any kind
  • Act as your agent with any government authority

No attorney-client relationship is created by your use of WizDox. If you need legal advice regarding vital records, immigration, inheritance, or related matters, consult a licensed attorney.

WizDox is not affiliated with any U.S. federal, state, or local government agency.

3. ELIGIBILITY

You must be at least 18 years of age to use the Platform. By using WizDox, you represent and warrant that you are 18 or older and have the legal capacity to enter into this agreement.

The Platform is intended for use in connection with U.S. vital records only. WizDox does not currently support vital records from countries outside the United States.

4. ACCOUNT REGISTRATION

To use WizDox, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your account credentials confidential
  • Notify us immediately at support@wizdox.com if you suspect unauthorized access to your account
  • Be responsible for all activity that occurs under your account

WizDox reserves the right to suspend or terminate accounts that violate these Terms or that contain demonstrably false information.

5. ACCURACY OF INFORMATION YOU PROVIDE

The quality of your generated form depends entirely on the accuracy of the information you provide. You are solely responsible for:

  • Entering accurate personal information for yourself and for the subject of the record
  • Verifying that all extracted and auto-filled fields are correct before downloading your form
  • Ensuring that the information on the submitted form matches your identity documents

WizDox is not liable for rejected applications, processing delays, or incorrect records resulting from inaccurate information provided by you.

6. YOUR RESPONSIBILITY FOR MAILING AND GOVERNMENT FEES

WizDox provides mailing instructions specifying the correct address, fee amount, payment method, required enclosures, and any notarization requirements for your specific request. You are solely responsible for:

  • Mailing the completed form and enclosures to the correct address
  • Enclosing the correct payment amount in the correct form (check, money order, etc.) made payable to the correct government entity
  • Meeting any notarization or identity verification requirements
  • Using appropriate postage and return envelope where required
  • Retaining proof of mailing (tracking number, postal receipt)

Government fees are separate from and in addition to WizDox's service fee. Government fees are paid directly to the relevant U.S. state or federal authority and are not collected, processed, or controlled by WizDox.

7. PAYMENTS

WizDox charges a service fee for each order placed on the Platform. Fees are displayed clearly before checkout. Payment is processed securely by Stripe, Inc. All fees are charged in U.S. dollars (USD). By placing an order, you authorize WizDox to charge the stated service fee to your selected payment method.

Pricing is subject to change. Any price changes will be communicated in advance and will not affect orders already placed.

8. INTELLECTUAL PROPERTY

All content on the Platform — including the WizDox name, logo, design, software, generated form templates, and written content — is the intellectual property of Daniel Barna (trading as WizDox) and is protected under applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose. You may not reproduce, copy, distribute, modify, or create derivative works of any WizDox content without prior written permission.

The government forms used as templates are publicly available documents issued by U.S. government agencies. WizDox does not claim ownership of those underlying forms.

9. PROHIBITED USES

You agree not to:

  • Use the Platform for any unlawful purpose
  • Submit false, fraudulent, or misleading information
  • Attempt to access another user's account
  • Use the Platform to prepare applications on behalf of third parties for commercial resale (unless operating under a WizDox B2B agreement)
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Use automated tools (bots, scrapers) to access the Platform without written permission
  • Impersonate any person or entity

10. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

WizDox's total liability to you for any claim arising out of or relating to these Terms or your use of the Platform — regardless of the form of the action — shall not exceed the total service fees paid by you to WizDox in the three (3) months preceding the claim.

WizDox is not liable for:

  • Any government authority's decision to reject, delay, or fail to process your application
  • Postal or courier losses, delays, or damage
  • Your failure to follow the mailing instructions provided
  • Any consequences of incorrect information you provided to WizDox
  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of records, data, or documents due to causes outside WizDox's reasonable control

For B2C users: Nothing in these Terms limits or excludes rights you may have as a consumer under mandatory provisions of Portuguese law or EU consumer protection law, including Directive 2011/83/EU. If any provision of these Terms conflicts with your statutory consumer rights, your statutory rights prevail.

11. DISCLAIMER OF WARRANTIES

The Platform is provided "as is" and "as available." WizDox makes no warranties, express or implied, regarding:

  • The accuracy, completeness, or timeliness of the mailing instructions
  • The fitness of the generated forms for any particular purpose
  • Uninterrupted or error-free operation of the Platform

WizDox makes reasonable efforts to keep state-specific mailing instructions current, but government addresses, fees, and requirements can change. Always verify critical details directly with the relevant government office before mailing.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Daniel Barna (trading as WizDox) and any associates or agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with:

  • Your violation of these Terms
  • Your use of the Platform
  • False or inaccurate information you provided
  • Your violation of any third-party rights

13. TERMINATION

WizDox may suspend or terminate your account at any time, with or without notice, if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law.

You may delete your account at any time from your account settings. Upon deletion, your personal data will be handled in accordance with the Privacy Policy.

14. CHANGES TO THE SERVICE AND TERMS

WizDox reserves the right to modify the Platform or these Terms at any time. For material changes, we will provide at least 14 days' notice by email or prominent notice on the Platform. Your continued use after the effective date of the change constitutes acceptance. If you do not agree with a material change, you may close your account before it takes effect.

15. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of Portugal and applicable European Union law, without regard to conflict of law principles.

For B2C users: You may bring any dispute before the courts of your country of residence within the EU, or use an EU-approved alternative dispute resolution (ADR) body. The European Online Dispute Resolution platform is available at: ec.europa.eu/consumers/odr.

For B2B users: Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Lisbon, Portugal.

For informal resolution, please contact us first at support@wizdox.com. We commit to responding within 10 business days and will make a good-faith effort to resolve disputes without formal proceedings.

16. SEVERABILITY

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and WizDox with respect to the Platform and supersede all prior agreements and understandings.
